COBRA and Pre-Existing Conditions

Another scenario that may have affected employers offering COBRA prior to the 2014 effectiveness of PPACA was the treatment of a qualified beneficiary who elects COBRA and then becomes eligible for another health plan.  He/she generally would have automatically becomes ineligible and terminated from COBRA. However, if the new health plan excluded certain conditions (pre-existing conditions), the other coverage would not have resulted in COBRA coverage terminating, and the qualified beneficiary would have been entitled to keep his/her COBRA plan until it expired, or until he/she was no longer eligible.  However, in 2014 as PPACA became effective, the pre-existing condition exclusions no longer applied.
